The Kanawha County Circuit Court has given preliminary approval to settlement of a class action Mountain State Justice brought against a Maryland collection law firm and collection attorney which regularly asked that West Virginia consumers pay amounts the law did not allow. There may be as many as 800 persons who received collection letters or lawsuits from E.J. Hagan Associates and attorney E.J. Hagan after January 1, 2011 about debts alleged owed to Atlantic Credit & Finance, Inc., Atlantic Credit & Finance Special Finance Unit, LLC, Atlantic Credit & Finance Special Finance Unit III, LLC, Midland Funding, LLC, Midland Credit Management, Inc., NCEP, LLC, Credigy Receivables, Inc., Velocity Investments, LLC, Riverwalk Holdings, Ltd., Jefferson Capital Systems, LLC, 1st Financial Bank USA, and/or Crescent Bank & Trust (a/k/a Crescent Bank New Orleans, Crescent Bank, Inc.)
The settlement created a class settlement fund of $100,000.00 which will be equally divided between all class members who fill out and file a claim form by September 5, 2019. If you or someone you know did or may have received a collection letter or lawsuit from attorney E.J. Hagan or E.J. Hagan Associates, you must file a claim by September 5, 2019 or lose any rights you have. Please read the Class Notice and the Class Settlement Agreement for a more specific explanation of your rights and how to claim or protect them.
If you or someone you know are not sure whether a collection letter of lawsuit was received from E.J. Hagan or E.J. Hagan Associates after January 1, 2011, Class Counsel suggests you print out the Claim, Opt Out and Objection Form from the link below, fill it out, and send it to the Class Administrator. With the information on the claim form, the Class Administrator will be able to determine if you are a class member entitled to share in the settlement.
